Cultivation of Marijuana

Have been charged with cultivation of marijuana?

Under ARS 13-3405(A)(3), it is illegal to knowingly produce marijuana.  This is commonly referred to as “cultivation of marijuana”.

 

Possible Punishments for Cultivation of Marijuana

Amount Produced has a Dried Weight of Less than 2 Pounds (Class 5 Felony):

  • First offense- Probation with up to 1 year in county jail; If prison is ordered by the judge then 6 months to 2.5 years in prison;
  • If you have 1 Historical Prior Felony Conviction- 1 year to 3.75 years in prison;
  • If you have 2 Historical Prior Felony Convictions- 3 years to 7.5 years in prison.

 

Amount Produced has a Dried Weight of 2-4 Pounds (Class 4 Felony):

  • First offense- Mandatory 1 year to 3.75 years in prison;
  • If you have 1 Historical Prior Felony Conviction- 2.25 years to 7.5 years in prison;
  • If you have 2 Historical Prior Felony Convictions- 6 years to 15 years in prison.

 

Amount Produced has a Dried Weight of over 4 pounds (Class 3 Felony):

  • First offense: 2 years to 8.75 years in prison;
  • If you have 1 Historical Prior Felony Conviction- 3.5 years to 16.25 years in prison;
  • If you have 2 Historical Prior Felony Convictions- 7.5 years to 25 years in prison.

 

In addition, you will be subject to mandatory fines.
